Throughout any correspondence and/or communications, the terms “I”, “we”, “us” and “our” refer to the entity, Chubby Bubs. By visiting our page and/or contacting us and/or purchasing something from us, you engage in our “Service” and unconditionally agree to be bound by the stated Terms & Conditions, Terms of Service and Privacy Policy (collectively known as "Policy"). Kindly read the Policy carefully before using our service.
If you do not agree to all the Policy in agreement, you may not use our Service.
You shall not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
Prices on the menu may be subject to change without notice and we reserve the right to modify or discontinue the Service, at any time.
We shall not be held liable to you and/or any third party for any modification, price change, suspension, discontinuance of the Service (non exhaustive).
We will made every effort to display the colors, design and images of our products, as accurately as possible. However, we will not warrant that the quality of the product and/or Service will meet your expectations, or that any errors in the Service will be rectified. Our products are handmade items and despite reasonable efforts, we will not warranty that the identity of the final product will match your expectations. We are under no obligation to compensate you for any dissatisfaction in the Service.
Additionally, we will have no liability to you and/or any third party for any direct or indirect loss, emotional distress resulting from this incident.
We may monitor, edit or remove Facebook comments/content that we determine in our sole discretion which are unlawful, offensive, threatening, defamatory or otherwise violates any party’s intellectual property or these Terms & Conditions (non exhaustive).
Additionally, you agree that your comments will not violate any right of any third party and will not contain unlawful, abusive, harassing in nature (non exhaustive). You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.
You agree to indemnify and hold harmless Chubby Bubs and our partners, shareholders, directors and any persons engaged in providing the Service, harmless from any claim and/or demand, including reasonable attorneys’ fees, made by any first and/or third party due to or arising out of your breach of these Terms & Services or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
You shall not use our Service, if you or any third parties have any allergies. We shall not be held liable to you and/or any third party as a result of any medical conditions which may arise from direct or indirect use of our products.
Your purchase order (“Order”) constitutes an offer to us to buy a product. After placing an Order, you will receive an email from us. Please read the Order confirmation carefully.
If there is/are any error(s) in the Order confirmation, you have to notify us as soon as possible. If notification is done less than 4 days in advance, we may not be able to rectify the error. If you wish to add or change details of the product, we will require a minimum 7 days advance notice.
For changes in date and/or time of delivery, we shall take reasonable efforts (without any obligation) to accommodate you, provided that you notify us with a minimum of 3 days advance notice. We reserve the right to make changes to the delivery charges.
The final price (“Price”) payable for the Service is stated in the Order form. Kindly note that there will be no negotiation of Price or waiver of fees deviating from the final amount.
We will require a minimum of 50% deposit in the form of fund transfer, upon confirmation of your Order. Do note that your Order is only confirmed, upon our verification that the deposit has been received. The balance amount can be paid upon collection or delivery of the product(s).
In the event that the order needs to be cancelled after an order confirmation has been issued, please note the following cancellation policies:
More than 2 weeks notice: 25% cancellation charge on deposit
Less than 2 weeks notice: 50% cancellation charge on deposit
Less than one week notice: 100% cancellation charge on deposit
The cancellation charge will be offset from the deposit. There will not be waivers considered even due to unforeseen circumstances to ensure fairness to our customers and us.
Notwithstanding the aforementioned, we reserve the right to refuse Service to anyone for any reason at any time.
